KUCHING (Feb 19): A beauty and spa owner was fined RM25,000 in default six months in jail by the Sessions Court here today for operating an unlicensed private dental clinic by offering veneer-fitting services.
Judge Saiful Bahari Adzmi imposed the fine on Norsuzela Sabini, 38, after she pleaded guilty to a charge under Section 4(1) of the Private Healthcare Facilities and Services Act 1998, punishable under Section 5(1) of the same Act.
The Section provides for a fine of up to RM300,000 or imprisonment for up to six years, or both, upon conviction.
Norsuzela committed the offence at a beauty and spa centre in Matang Metrocity Square here at around 11am on Aug 16, 2023.
Based on the facts of the case, a multi-agency enforcement team raided the premises on suspicion that it was being used as an unregistered private dental clinic.
Norsuzela, as the premises owner, failed to present the clinic’s registration documents and an Annual Practicing Certificate (APC) during the raid.
The Malaysian Dental Council later confirmed that Norsuzela was not a registered dental practitioner and had never been issued an APC.
Checks also found that the business was only registered for beauty services; sale of clothing, handbags, beauty products and women’s accessories; and room rentals.
The prosecution was conducted by prosecuting officers Hamsulnizam Kassim and Nozaizeli Abu Samah, while Norsuzela was unrepresented.
